Introduction
SOC Defenders respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our service that are reported to our designated copyright agent.
This policy outlines how we handle DMCA takedown notices and counter-notifications, as well as our repeat infringer policy.
Reporting Copyright Infringement
If you believe that content available on SOC Defenders infringes your copyright, you may submit a DMCA takedown notice. To be effective, the notice must be a written communication that includes the following:
- Identification of the copyrighted work: Identify the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: Identify the material that you claim is infringing and that you want removed or access to which you want disabled, and provide information reasonably sufficient to permit us to locate the material (e.g., the URL of the page containing the material).
- Your contact information: Provide your name, mailing address, telephone number, and email address.
- Statement of good faith: Include the following statement: "I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
- Statement of accuracy: Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."
- Signature: Include your physical or electronic signature.
Designated Copyright Agent
Please send your DMCA takedown notice to our designated copyright agent at:
Important: Only DMCA notices should be sent to the designated copyright agent. Any other inquiries or feedback should be directed to our contact page.
Our Response to Valid DMCA Notices
Upon receiving a valid DMCA takedown notice, we will:
- Remove or disable access to the allegedly infringing material
- Notify the user who posted the content about the removal
- Provide the user with a copy of the takedown notice
- Inform the user of their right to submit a counter-notification
Counter-Notification
If you believe that content you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification. Your counter-notification must be a written communication that includes:
- Identification of the material: Identify the material that was removed or disabled and the location at which the material appeared before it was removed or disabled.
- Statement under penalty of perjury: Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
- Consent to jurisdiction: Include the following statement: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside the United States, for any judicial district in which SOC Defenders may be found, and I will accept service of process from the person who provided the original notification or an agent of such person."
- Your contact information: Provide your name, address, telephone number, and email address.
- Signature: Include your physical or electronic signature.
Send counter-notifications to: dmca@socdefenders.ai with the subject line "DMCA Counter-Notification."
Response to Counter-Notifications
Upon receiving a valid counter-notification, we will:
- Promptly provide the original complainant with a copy of the counter-notification
- Inform the complainant that we will replace the removed material or cease disabling it in 10 business days
- Replace the removed material or cease disabling access to it in 10-14 business days unless we receive notice that the complainant has filed a court action seeking to restrain the user from engaging in infringing activity
Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
A "repeat infringer" is any user who has been the subject of more than two valid DMCA takedown notices within any 12-month period.
Misrepresentation
Please note that the DMCA provides that any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.
If you are not sure whether material available online infringes your copyright, or whether material was removed by mistake, we recommend consulting an attorney before submitting a notice or counter-notification.
Special Considerations for Cybersecurity Content
SOC Defenders aggregates cybersecurity news from various sources. Please note:
- News headlines and links: We typically display headlines and short excerpts from news sources, which generally constitutes fair use. However, we will remove content upon valid DMCA notice.
- User-submitted content: Users may submit links to articles. We are not responsible for the content of linked external websites.
- AI-generated summaries: Our AI-generated article summaries are transformative works created for informational purposes. If you believe a summary infringes your rights, please contact us.
- Security research: We support legitimate security research and responsible disclosure. Requests to remove security research must demonstrate clear copyright infringement, not merely dissatisfaction with the research findings.
Modifications to This Policy
We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting the updated policy. Continued use of our services after changes constitutes acceptance of the modified policy.
